Surah An-Noor Verse 5

إِلَّا الَّذِينَ تَابُوا مِنْ بَعْدِ ذَٰلِكَ وَأَصْلَحُوا فَإِنَّ اللَّهَ غَفُورٌ رَحِيمٌ



Except for those who repent thereafter and reform, for indeed, Allah is Forgiving and Merciful.

(O ye who believe! Enter not houses other than your own…) [24:27-29]. Ahmad ibn Muhammad ibn Ibrahimal-Tha‘labi informed us> al-Husayn ibn Muhammad ibn ‘Abd Allah al-Dinawari> ‘Abd Allah ibn Yusuf ibnAhmad ibn Malik> al-Husayn ibn Sakhtawayh> ‘Umar ibn Thawr and Ibrahim ibn Abi Sufyan> Muhammadibn Yusuf al-Firyabi> Qays> Ash‘ath ibn Siwar> ‘Adiyy ibn Thabit who said: “A woman from the Helperswent to see the Prophet and said: ‘O Messenger of Allah, sometimes I am in my house in a state in which Ido not like anyone to see me, neither father nor son. But then the father comes in or another man of thefamily comes in while I am in that state, what shall I do?’ [As a response] this verse was revealed (O ye whobelieve! Enter not houses other than your own without first announcing your presence and invoking peaceupon the folk thereof)”. The commentators of the Qur’an said: “When this verse was revealed, Abu Bakr al-Siddiq, may Allah be well pleased with him, said: ‘O Messenger of Allah, what about the inns and housesalong the roads of Syria which are uninhabited?’ Allah, exalted is He, then revealed ((It is) no sin for you toenter uninhabited houses) [24:29]”.

وَالَّذِينَ يَرْمُونَ الْمُحْصَنَـتِ ثُمَّ لَمْ يَأْتُواْ بِأَرْبَعَةِ شُهَدَآءَ فَاجْلِدُوهُمْ ثَمَانِينَ جَلْدَةً وَلاَ تَقْبَلُواْ لَهُمْ شَهَادَةً أَبَداً وَأُوْلَـئِكَ هُمُ الْفَـسِقُونَ إِلاَّ الَّذِينَ تَابُواْ مِن بَعْدِ ذَلِكَ وَأَصْلَحُواْ فَإِنَّ اللَّهَ غَفُورٌ رَّحِيمٌ

(4. And those who accuse chaste women, and produce not four witnesses, flog them with eighty stripes, and reject their testimony forever. They indeed are the rebellious.)

(5. Except those who repent thereafter and do righteous deeds; (for such) verily, Allah is Oft-Forgiving, Most Merciful.)

The Prescribed Punishment for slandering Chaste Women

This Ayah states the prescribed punishment for making false accusations against chaste women, i.e., those who are free, adult and chaste. If the person who is falsely accused is a man, the same punishment of flogging also applies. If the accuser produces evidence that what he is saying is true, then the punishment does not apply. Allah said:

ثُمَّ لَمْ يَأْتُواْ بِأَرْبَعَةِ شُهَدَآءَ فَاجْلِدُوهُمْ ثَمَانِينَ جَلْدَةً وَلاَ تَقْبَلُواْ لَهُمْ شَهَادَةً أَبَداً وَأُوْلَـئِكَ هُمُ الْفَـسِقُونَ

(and produce not four witnesses, flog them with eighty stripes, and reject their testimony forever. They indeed are the rebellious.) If the accuser cannot prove that what he is saying is true, then three rulings apply to him: (firstly) that he should be flogged with eighty stripes, (secondly) that his testimony should be rejected forever, and (thirdly) that he should be labelled as a rebellious who is not of good character, whether in the sight of Allah or of mankind.

Explaining the Repentance of the One Who makes a False Accusation

Then Allah says:

إِلاَّ الَّذِينَ تَابُواْ مِن بَعْدِ ذَلِكَ وَأَصْلَحُواْ فَإِنَّ اللَّهَ غَفُورٌ رَّحِيمٌ

(Except those who repent thereafter and do righteous deeds; (for such) verily, Allah is Oft-Forgiving, Most Merciful.) This exception refers to the second and third rulings mentioned above. The flogging has been carried out regardless of whether he repents or persists, and after that there is no further punishment, as is agreed among the scholars. If he repents, then his testimony may be accepted, and he is no longer to be regarded as a rebellious. This was the view of Sa`id bin Al-Musayyib -- the leader of the Tabi`in -- and also a group among the Salaf. Ash-Sha`bi and Ad-Dahhak said, "His testimony cannot be accepted even if he does repent, unless he himself admits that he said something false, in which case his testimony may be accepted.'' And Allah knows best.

Menurut Syaikh As Sa’diy, tobat dalam hal ini adalah dengan ia mendustakan dirinya sendiri, mengakui bahwa ucapanya dusta, dan hal ini wajib baginya, yakni mendustakan dirinya meskipun ia merasa yakin terjadi perbuatan itu, karena ia tidak mendatangkan empat orang saksi. Jika penuduh itu telah bertobat dan memperbaiki amalnya, maka ia ganti perbuatan buruknya dengan perbuatan baik, sehingga kefasikannya pun hilang. Demikian pula persaksiannya akan kembali diterima menurut pendapat yang sahih, karena Allah Maha Pengampun lagi Maha Penyayang, Dia mengampuni dosa-dosa semuanya bagi orang yang bertobat dan kembali. Dideranya si penuduh ini, jika ia tidak mendatangkan empat orang saksi dan jika ia bukan suaminya. Apabila ia sebagai suaminya, maka berlaku hukum yang lain baginya, yaitu li’an sebagaimana diterangkan dalam ayat selanjutnya.

Dengan inilah kefasikan mereka hilang dan persaksiannya diterima.
